RoyaltyHit is a web-based tool designed to help stock photography contributors analyze and visualize their royalty earnings data. The Service provides:

• Upload and storage of royalty statement files
• Parsing and analysis of royalty data
• Dashboard visualizations, charts, and statistics
• Search and filtering capabilities for your content performance
• Historical tracking of earnings and downloads

Important: RoyaltyHit is a free, community-created tool provided "as-is" with no guarantees of accuracy, completeness, or continued availability. We are not a financial advisor, tax consultant, or official representative of any stock photography platform.

4. Eligibility and Account Registration

4.1 Eligibility Requirements

To use RoyaltyHit, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal right to access and use the Service
• Not be prohibited by law from using the Service
• Maintain only one active account per person

4.2 Account Registration

When you create an account:

• You must provide accurate, current, and complete information
• You must maintain and promptly update your account information
• You may optionally set a nickname (display name) that will appear in the navigation bar. Nicknames must comply with our Acceptable Use Policy
• You are responsible for maintaining the confidentiality of your password
• You are fully responsible for all activities under your account
• You must immediately notify us of any unauthorized use of your account

4.3 Account Security

• Choose a strong, unique password not used on other websites
• Never share your password with anyone
• Log out after each session when using shared or public computers
• We are not liable for any loss or damage from your failure to protect your account credentials

5. User Responsibilities

As a user of RoyaltyHit, you agree to:

• Upload only your own royalty statements and data
• Verify the accuracy of uploaded information
• Understand that analytics are based on your uploaded data and may contain errors
• Not rely solely on RoyaltyHit for tax reporting or official financial records

• Respect intellectual property rights of third parties
• Not violate any terms of service of Getty Images, iStock, or other platforms
• Not use the Service for any unlawful or fraudulent purpose

5.3 Data Privacy

• Understand that you are voluntarily uploading sensitive financial information

• Acknowledge that no online service can guarantee 100% security
• Take appropriate precautions to protect your own data

6. Acceptable Use Policy

You agree NOT to use the Service to:

• Upload content that infringes intellectual property rights
• Upload statements belonging to other users without authorization
• Upload files containing fraudulent or falsified data
• Use the Service to store or distribute illegal content

6.3 Prohibited Conduct

• Impersonate any person or entity or misrepresent your affiliation
• Use nicknames that are offensive, misleading, impersonate others, or violate third-party rights
• Choose nicknames that are already in use by another user
• Harass, abuse, or harm other users
• Share your account credentials with others
• Create multiple accounts to evade restrictions
• Sell, rent, lease, or transfer your account to others

6.4 Consequences of Violation

Violation of this Acceptable Use Policy may result in:

• Immediate termination of your account without notice
• Deletion of all your data and content
• Reporting to law enforcement authorities if applicable
• Legal action to recover damages and costs

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including its design, layout, software code, graphics, user interface, functionality, and all related materials, is owned by or licensed to RoyaltyHit and is protected by copyright, trademark, and other intellectual property laws.

You may not:

You retain ownership of the royalty statements and data you upload. However, by uploading content to the Service, you grant us a limited license to:

• Create backups for disaster recovery purposes

• Any other stock photography platform, agency, or marketplace
• Any government or regulatory agency

8.2 No Official Endorsement

Getty Images does not endorse the use of RoyaltyHit. Any mention of Getty Images, iStock, or other third-party brands is for identification and descriptive purposes only.

8.3 Trademarks

• All third-party trademarks, logos, and brand names are the property of their respective owners
• Use of these marks does not imply any affiliation, endorsement, or partnership
• We do not claim any ownership rights to third-party intellectual property
• "Getty Images," "iStock," and related marks are trademarks of Getty Images, Inc.

8.4 Copyright Notice for Uploaded Content

All photography, video, and creative content referenced in royalty statements (product IDs, titles, etc.) remains the property of the original creators and Getty Images. RoyaltyHit only processes metadata for analytics purposes and does not host, display, or distribute the actual creative works.

9. User Content and Data

9.1 Your Responsibility

You are solely responsible for:

• The accuracy and legality of content you upload
• Ensuring you have the right to upload and share the data
• Any consequences arising from your uploaded content
• Maintaining your own backups of important data

9.2 Data Verification

RoyaltyHit attempts to parse and analyze your royalty statements accurately, but:

• We do not guarantee 100% accuracy in data parsing
• Errors may occur due to format changes, file corruption, or parsing limitations
• You should verify important figures against your original statements
• We are not responsible for financial decisions based on our analytics

9.3 Data Deletion

You may delete your data at any time through your account settings. Upon deletion:

• Your data will be permanently removed from active systems within 30 days
• Backup copies may persist for up to 30 additional days before being purged
• Aggregated, anonymized analytics may be retained for service improvement

10. Privacy and Data Protection

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

13. Limitation of Liability

13.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROYALTYHIT, ITS OPERATORS, AFFILIATES, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Data loss, corruption, or unauthorized access
• Service interruptions, downtime, or unavailability
• Errors, inaccuracies, or omissions in data or analytics
• Unauthorized access to your account or data
• Any third-party actions or content

This exclusion applies even if we have been advised of the possibility of such damages, and regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).

13.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF:

• The amount you paid to us in the 12 months preceding the claim, OR
• $100 USD (or equivalent in your local currency)

13.3 Essential Purpose

The limitations in this section are fundamental elements of the basis of the bargain between you and RoyaltyHit. The Service would not be provided without these limitations.

13.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless RoyaltyHit, its operators, affiliates, employees, contractors, and service providers from any and all:

• Claims, demands, actions, or proceedings
• Losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees)

Arising from or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any law or regulation
• Your infringement of any third-party rights
• Any content or data you upload or submit
• Any damage or harm to third parties caused by you

This indemnification obligation will survive termination of these Terms and your use of the Service.

15. Termination

15.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in Settings
• Contacting us at support@royaltyhit.com

Upon termination, your data will be deleted in accordance with our Privacy Policy.

15.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service, immediately and without notice, for any reason, including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent, abusive, or illegal activity
• Extended period of inactivity
• Requests by law enforcement or government agencies
• Technical or security concerns
• Discontinuation of the Service

15.3 Effect of Termination

Upon termination of your account:

• Your right to access and use the Service immediately ceases
• All licenses granted to you are revoked
• Your data will be deleted in accordance with our Privacy Policy
• We have no obligation to maintain or provide copies of your data
• Sections of these Terms that by their nature should survive will remain in effect

15.4 Survival

The following sections survive termination: Intellectual Property Rights, Disclaimers and Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of laws principles.

16.2 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service:

• Negotiation Period: Allow 30 days for good-faith negotiations before pursuing formal action
• Jurisdiction: Any legal action must be brought in a court of competent jurisdiction

16.3 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

• The "Last Updated" date at the top will be revised
• Material changes will be communicated via email to registered users
• Continued use of the Service after changes constitutes acceptance
• If you do not agree to the changes, you must stop using the Service and close your account

18. Miscellaneous Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RoyaltyHit and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.

18.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your account to any third party without our written consent. We may assign these Terms without restriction.

18.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service failures.

18.6 Language

These Terms are provided in English. Any translations are for convenience only, and the English version governs in case of conflict.
